Policy Statement

 

This policy is developed to align with the amendments to Subsection 36.0.2 of Ontario Regulation 415/06 (General) under the Ontario Private Career Colleges Act, 2005. The policy aims to protect students from sexual violence and harassment and to provide a safe and respectful educational environment.

 

Key Amendments to the Regulation


  1. Good Faith Reporting Protection:

    Students who report or make complaints about sexual violence in good faith will not face discipline or sanctions for policy violations regarding drug or alcohol use at the time of the alleged incident.


  2. Irrelevant Questions:

    Students disclosing experiences of sexual violence through complaints or access to support services will not be subjected to irrelevant questions during investigations, such as those about their sexual history or expression.

 1.     Policy Scope

The policy applies to all students and incidents occurring on campus or during official events of Prime International College of Health Care and Technology.

2.     Policy Objectives

The college commits to:

 

  • Providing an educational environment free from sexual violence.

  • Supporting students who report sexual violence by offering resources, counseling, and academic accommodations.

  • Educating students, management, employees, and contractors on identifying and preventing sexual violence.

3.     Definitions

Sexual violence includes any act targeting a person’s sexuality, gender identity, or gender expression without consent. It encompasses sexual assault, harassment, stalking, indecent exposure, and exploitation.

4.     Reporting and Responding


  • Reports of sexual violence should be made to the Office Manager or School Administrator.

  • The college ensures confidentiality, except when imminent risk to individuals or the community necessitates disclosure.

  • The complainant determines how the complaint will proceed, except in cases of legal obligations or risks to community safety.

5.     Investigative Procedures

Upon receiving a complaint:

  • Immediate assessment for police referral

  • Interim measures implemented as required.

  • Interviews with the complainant, respondent, and witnesses.

  • Regular updates provided to all parties involved.

  • Disciplinary actions determined based on findings.

6.      Disciplinary Actions

Disciplinary actions for confirmed cases of sexual violence may include termination of employment or expulsion of students.

7.     False Statements

Knowingly making false complaints is a policy violation and will result in appropriate disciplinary measures.

8.     Review and Compliance

The policy will undergo review every three years to ensure compliance with legislative changes and best practices.

9.     Student Data Collection

Prime International College will collect and provide data to the Superintendent of Ontario Career Colleges as mandated under Subsections 32.3 (8), (9), and (10) of the Act.
